Terms and Conditions

These terms govern your use of this website and set out the baseline for engaging Pixy Puala (“I”, “me”) for WordPress engineering work. A signed statement of work (SOW) for a specific project takes precedence over anything here. Questions: pixpuala@gmail.com.

Using this website

The content here — writing, code snippets, checklists, and downloadable resources — is provided for information. You may use the freely downloadable resources under the licence stated with each (typically MIT or CC-BY). Everything else, including case studies, copy, and design, remains my property and may not be copied or republished without permission.

No warranty on free resources

Downloadable snippets and templates are provided “as is”, without warranty of any kind. Test them in a staging environment before using them in production. I am not liable for any loss arising from use of a free resource.

Engagements & scope

Paid work is defined by a written SOW that names the deliverables, timeline, fee, and acceptance criteria. Work outside the SOW is handled through a written change request with its own price and timeline. Verbal changes are not binding.

Fees & payment

Fees are fixed per the SOW unless stated as time-and-materials. Invoices are due on the schedule set in the SOW (typically a deposit to start, with the balance across milestones). Work may pause on overdue invoices after reasonable notice.

Ownership & intellectual property

On full payment, custom code written specifically for your project is transferred to you. Pre-existing tools, libraries, and general know-how I bring to the work remain mine and are licensed to you for use in the delivered site. Third-party components keep their own licences.

Warranty

Delivered work carries the defect-fix warranty stated in the SOW (typically 14 days from launch, covering deviations from the agreed acceptance criteria). The warranty does not cover third-party plugin or host faults, or changes made after handover by others.

Confidentiality

Non-public information shared for an engagement is kept confidential and used only to deliver the work. I am happy to sign a mutual NDA where required.

Limitation of liability

To the extent permitted by law, my total liability for any engagement is limited to the fees paid for that engagement. I am not liable for indirect or consequential loss, including lost profit or data, arising from the work or the use of this site.

Independent contractor

I work as an independent contractor. Nothing here creates an employment, partnership, or agency relationship.

Governing law

These terms and any engagement are governed by the law agreed in the SOW; where none is stated, by the law of my place of business. Disputes are handled there.

Changes

These terms may be updated as the site or services change. The date below marks the current version; the SOW in force for your project always controls.
