Why this matters now

The European Accessibility Act's enforcement window opened on 28 June 2025. In November 2025, France filed the first EAA-related lawsuits against Auchan, Carrefour, E.Leclerc, and Picard. As of May 2026, no fines have yet been issued under any EAA-transposed law, but the legal exposure is live and regulators have begun acting.

Penalties are not standardised across the EU. Each member state sets its own schedule. Germany: up to €100,000 per individual violation. France: up to €250,000 for systemic non-compliance. Spain: €1,000,000 for "very serious" infractions.

The part most UK B2Bs miss: the EAA covers business-to-business digital services, not just consumer retail. UK companies are not directly bound by the EAA, but UK B2Bs serving any EU customers, prospects, or end-users are exposed through their EU establishments and EU-resident user populations.
